There is a “plethora”of circumstantial evidence that could be enough to convict Caleb Flynn of murdering his wife Ashley Flynn, former FBI agent and Fox News contributor James Gagliano said Monday. Caleb’s defense is arguing the accusations against him are “character assassination,” Gagliano said.”They are arguing that a bad spouse does not equate to a murder and they are arguing that there was no DNA or latent fingerprints recovered at the crime scene.” But that may not matter, he continued. “I was involved in many cases during my FBI career where circumstantial evidence was enough. In this instance you have a body, the deceased wife of Caleb Flynn. Number 2 you have a motive,” he continued. “Number 3 you don’t need the weapon used here and lastly on the motive part, the state has successfully argued the motive here come a reputational damage from a divorce, financial ruin that could come from a divorce and a child custody issue.” Investigators made a “mistake” by not testing Caleb for gun powder residue, he added. Gagliano continued: It’s easy to sit back in hindsight and suggest that that was a mistake. This case, going back to the motive that you tie into the physical evidence, again, I think it was the 4ls [that] a senior detective told me always come back in a murder case, in this instance: love, lust, loathing, lucre. Dirty money. This has the top 3 involved. I think there’s enough evidence here right now. Again, cases, you can get convictions on circumstantial evidence alone, and there is a plethora of it here. Caleb is accused of shooting Ashley in the head twice as she slept so he could be in a relationship with his young mistress, Alleigha Botner, who testified in the trial against him. He and Botner exchanged over 100,000 text messages, many of which included disparaging comments about Ashley and wishes for her death. Caleb and Ashley shared two daughters, who were home at the time of their mother’s murder. Caleb told investigators that an unknown assailant broke in and killed Ashley. The defense rested Monday without calling any witnesses to the stand.
