Any Department of Justice case against Dr. Fauci would “crash and burn,” warned CNN’s senior legal analyst Elie Honig in an interview with Stephen A. Smith Thursday. Honig also insisted that despite Republican claims to the contrary, “anyone in Dr. Fauci’s scenario would take the Fifth, and any lawyer who comes on here and tells you Fauci should not have taken the Fifth, you ask them, ‘Would you have advised someone in Dr. Fauci’s situation to take the Fifth?’ Because the answer better be yes. And if it’s not yes, then they’re not a competent lawyer.” He continued: So I think Republicans are wrong here. I think Fauci, like it or not, and I’m not arguing for or against Dr. Fauci as a doctor, his science, his medicine. I’ll leave that to other people. Legally, he had the right to take the Fifth. And now, if DOJ chooses to prosecute him, I think that case will crash and burn because DOJ, if they prosecute Fauci, is going to have to show beyond a reasonable doubt, that’s the highest burden in our legal system, that he did not have the right to take the Fifth. There is maybe some debate here, but they’re not going to be able to prove beyond a reasonable doubt that he was not legally entitled to take. Honig also said he thinks Sen. Rand Paul (R-KY) is more likely to try to charge Fauci with perjury. On Thursday, a Senate Committee led by Paul voted to hold Fauci in contempt for refusing to answer questions. The 8-7 vote was passed along party lines. “All he had to do was tell the truth,” Paul said before voting began. “There will be another pandemic. The time to determine which legislative reforms are necessary to make sure the mistakes of the past are not repeated is now, not later.” Watch the above via Stephen A. Xperi Inc. posted an 8% increase in revenue in the second quarter compared to a year earlier, helped by 54% growth in its advertising and related revenue. The technology company announced Q2 financial results on Wednesday. CEO Jon Kirchner cited “positive momentum in our business and the effectiveness of our strategy to grow both footprint and revenue on our platforms.” Xperi said monthly active users on its TiVo One platform grew 70 percent from last year, to 6.3 million, helping drive 54 percent year-over-year growth in advertising and related revenue. “Our AutoStage platform footprint grew 42 percent year-over-year to reach 17 million vehicles, and began generating revenue from listener analytics and data,” Kirchner said. [See the company’s summary slides for investors.] The company has been working to reverse some overall trends that it reported last year, when its revenue declined and net losses grew. Performance over the last couple of quarters has been more encouraging. For Q2, Xperi reported Q2 revenue of $114.5 million, up from $105.9 million in the quarter a year earlier. It posted a GAAP net loss in the quarter of $1.5 million, but an improvement on the loss of $14.8 million a year earlier. And it celebrated an increase of 61% in its adjusted EBITDA year over year. For Radio World readers, Xperi’s DTS AutoStage and HD Radio technologies are of most interest. The company said, “Continued growth in AutoStage platform footprint as well as new automotive OEM programs are beginning to accelerate advertising and related revenue.” During Q2, as we’ve reported, big EV maker BYD joined the AutoStage program as its 14th automotive brand and committed to deploy the audio and video platform across export models. In the quarter Xperi also signed Cumulus as the first customer for advanced analytics from the DTS AutoStage broadcaster portal.
